Starting a used car dealership in New Mexico: license, bond and insurance

Starting a small used car dealership in New Mexico? Understand dealer-license preparation, the $50,000 bond and garage liability insurance.

Applies to: NM

If you are getting ready to open a small used car dealership in New Mexico, plan the dealer application, bond and insurance before your intended opening date. A missing location document, inconsistent business name or incomplete bond file can interrupt the process.

BIG can help you prepare the bond and insurance side and identify the information needed for a coverage review. New Mexico MVD determines whether your dealer license application meets its requirements.

Call (612) 712-6407 and tell us you are starting a used dealership in New Mexico.

Start with MVD's used-dealer application requirements

Confirm the correct license category with the New Mexico Motor Vehicle Division. Selling vehicles as a business is different from occasionally selling your own car; do not treat a casual-sale allowance as a way to operate an unlicensed lot.

MVD's published dealer application guide lists ownership and tax-identification information, location and zoning documents, a dealer bond, photos or diagrams of the premises, and prelicensing education documentation for pre-owned dealers.

The guide is dated 2017, so confirm the current application route, education requirements, fees and document checklist with MVD before submitting. Use it to prepare the categories of information, not as a promise that today's screens or submission rules are unchanged.

Check the premises before committing to the opening date

Make sure the proposed location can support the dealership you intend to operate. Confirm local zoning, business licensing and MVD's premises requirements. Gather the applicable lease or ownership information and requested pictures of the office, vehicle display area and sign.

Keep the legal name and any doing-business-as name consistent across the state application, sign, bond and insurance documents. If another business will share the premises, tell the agent and check that arrangement with the licensing authority.

Prepare the $50,000 dealer bond

MVD's published guide calls for a $50,000 dealer bond. The face amount is not the same as the premium you pay to obtain the bond. A surety reviews the application and determines its price and terms.

The bond is not a substitute for garage liability or coverage on your inventory. It addresses obligations under the applicable bond; it does not automatically pay for a stolen vehicle or damage from a storm. The dealer can also have a reimbursement obligation to the surety following a paid claim.

Ask for the correct New Mexico dealer bond documents using the same entity information as the license application. Confirm any required signatures and effective dates before submitting them.

Discuss garage liability and the vehicles on your lot

Tell BIG how the dealership will operate: estimated inventory, maximum inventory value, test drives, employee and owner driving, transport from auctions, repairs and overnight storage. Disclose any customer vehicles you keep or work on.

Garage or dealer liability, physical damage on owned inventory and garagekeepers coverage address different exposures. Do not assume one policy name covers every vehicle and activity. If inventory is financed, include the lender's insurance requirements in the review.

MVD's dealer guidance also addresses dealer-plate use and vehicle insurance. Confirm the evidence needed for your particular application and plates, and have the agent review the required coverage separately from the additional protection your business may need.

Confirm what is active before you start selling

Submitting a license application is not the same as receiving a license. An insurance proposal is not the same as bound coverage. Confirm each status separately and coordinate the dates with your opening plan.

If the location, entity name or operations change during the application, tell MVD and your agent. Documents prepared for the earlier arrangement may need to be corrected.

Get help with your dealer bond and insurance

Have your business and ownership information, proposed location, application status, target opening date and expected inventory ready. If MVD has requested a particular document, share that request so the insurance discussion addresses it.

BIG can help you review available bond and insurance options for your proposed operation. Start with our dealer and garage liability information, or call (612) 712-6407 to discuss your New Mexico used dealership.
